Privacy Policy

It states legal obligations on his behalf, so nothing here should publish until he has read it line by line and confirmed the four CONFIRM items below. Written to reflect PHIPA and CPBAO record-keeping duties as they apply to a registered psychologist in sole private practice; it is not legal advice, and if he wants a lawyer's eye on it, this is the page that warrants it.

This policy explains what information I collect, why I collect it, how it is kept, and what rights you have over it.

Creative Psychological Services is the private practice of Dr. Steve Webne, Ph.D., C.Psych., registered with the College of Psychologists and Behaviour Analysts of Ontario (No. 3857). Under Ontario's Personal Health Information Protection Act, 2004 (PHIPA) I am a health information custodian, which means the law sets out specific duties for how I handle your information. I am also bound by the College's standards of professional conduct.

What I collect

From this website. If you use the consultation request form, I receive the name you give, the phone number you give, the days and times you indicate you could talk, and anything you choose to write in the optional message field. That is all the form asks for, and none of it is required beyond your name and a phone number.

This website does not use analytics, advertising pixels, or tracking cookies. I do not know who visits, how they got here, or what they read.

CONFIRMTrue as built — there is no analytics script on any page today, and the README defers analytics to a later phase. If click or engagement analytics are ever added, this paragraph has to change at the same time, or the policy becomes inaccurate the day the script goes in.

In the course of clinical work. If we go on to work together, I collect the personal health information needed to provide assessment or therapy: your history, the concerns that bring you in, assessment results, session notes, correspondence, and billing records. What is collected depends on the service, and I will explain it as part of obtaining your consent.

How I use it

I use your information to respond to your enquiry, to arrange and provide assessment and therapy, to keep the clinical records I am professionally required to keep, and to bill for services. I do not sell it, rent it, or share it for marketing of any kind.

Information is shared outside the practice only with your written consent — for example, a report sent to a school, a physician, or an insurer at your request — or where the law requires it.

Limits of confidentiality

Confidentiality is close to absolute, but not entirely. The law obliges me to act, sometimes without your consent, in a small number of situations:

  • If I believe there is a risk of serious harm to you or to another identifiable person.
  • If I have reasonable grounds to suspect that a child is or may be in need of protection, which I must report to a children's aid society.
  • If a court orders the release of records, or I am served with a subpoena or a search warrant.
  • If I learn that a regulated health professional has sexually abused a client, which I must report to that professional's College.
  • If the College of Psychologists and Behaviour Analysts of Ontario appoints an investigator or conducts a review of my practice.

Where one of these applies, I disclose only what the situation requires, and I will tell you what I have done wherever it is safe and lawful to do so.

How records are kept, and for how long

Records are stored securely, and access is limited to me. Paper records are kept locked; electronic records are kept on encrypted, password-protected systems.

Clinical records are retained for ten years after the date of the last interaction with you. Where the client was under eighteen at the time of the last interaction, records are retained for ten years after the date the client turned eighteen. Records are securely destroyed at the end of that period.

CONFIRMRetention periods stated from the College's record-keeping standard for Ontario psychologists. Dr. Webne to verify both figures against the current standard before publish — if the College has revised them, the page states a legal obligation incorrectly, which is worse than saying nothing.

A note about email. Ordinary email is convenient but not a secure channel — it can be intercepted, misdirected, or read on a device someone else has access to. I am glad to correspond by email about scheduling and general questions. Please don't send clinical detail that way; the telephone is better, and a session is better still.

Service providers

This website and my practice email are hosted by IONOS. Submissions from the consultation form are not stored on the website: each one is sent by email to my practice inbox, which IONOS also hosts.

CONFIRMHost now named (IONOS) and the form sends by email rather than storing anything on the site. Still to confirm: which IONOS data centre holds the website and the mail@drwebne.com mailbox (the IONOS contract or data processing agreement says). If it is outside Canada, that has to be said here plainly — cross-border storage of personal health information is exactly what people read a privacy policy to find out. Also confirm whether a practice-management system is in use and should be named; the Owl Practice portal was removed from the site in September 2026, so it is not listed here.

Your rights

You have the right to see the personal health information I hold about you, and to ask for a copy. You have the right to ask me to correct it if you believe it is inaccurate or incomplete. You have the right to withdraw your consent to my collecting, using, or sharing it, though in some cases that will mean I can no longer provide a service. You have the right to ask how your information has been handled.

There are narrow exceptions where access can be refused — for instance, where releasing a record could reasonably be expected to put someone at risk of serious harm. If I ever refuse a request, I will tell you why in writing, and I will tell you how to challenge that decision.

Questions and complaints

If you have a concern about how your information has been handled, please raise it with me first — most things are resolved that way, and I would rather hear it directly.

You also have the right to complain to the Information and Privacy Commissioner of Ontario, which oversees PHIPA, and to the College of Psychologists and Behaviour Analysts of Ontario, which oversees my practice. Going to either does not require going through me first.

Changes to this policy

If this policy changes, the revised version will be posted here with a new date. Material changes affecting how your information is used will be raised with you directly.
